TERMS AND AGREEMENTS

The charges for fiber services are specified above.  Prices do not include sales tax.  All applicable taxes will be added to the above charges billed.  By signing below, I state that I wish to subscribe to the fiber internet service provided by Falcon1, Inc.  I agree I am the sole party responsible for all communications and activities including, but not limited to, the use of this account by minors.  Speeds listed are maximum attainable download/upload speeds and are best effort delivered through a hardwired connection to the customer premise equipment.  Actual speeds may vary depending upon a variety of factors, many of which are related to the environment at the customer premise and the customer owned devices connecting to the broadband router, whether they are hardwired or utilizing Wi-Fi.  The subscriber agrees to use the service in compliance with all applicable federal, state, and local laws.  Prohibited activities include, but are not limited to: Illegal activity or transmission of unlawful content, network abuse, hacking, or interference with other users, resale or redistribution of service without written permission from Falcon1, Inc.  Non-payment will result in service suspension or termination.  Falcon1, Inc. shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the service.  The applicant agrees that he or she will abide by the by-laws, rules, and requisitions of the Minford Telephone Company and also agrees to permit the Minford Telephone Company to build, maintain, or remove aerial/buried fiber on the property of said applicant.  The applicant tenders herewith the required Membership Fee in the amount of $15.00 which is required before fiber service may be installed.  Said amount, when fully paid and approved, entitles said applicant to have fiber service installed and confers membership rights upon said applicant. (The $15.00 Membership Fee is not creditable towards future telephone bills and is not refundable after the service is installed.)
